eBay Bans Sales Of Certain Metaphysical Items

eBay Selling

eBay has recently enacted a policy to ban the auction selling of physic readings, magical spells, and potions on its site. The policy will begin on August 30, giving people who want such items scant time to make one last purchase. eBay has put a lot of thought into this process and still gone ahead with it,despite the fact that people seem to enjoy the  silly and harmless eBay selling of this nature.

eBay released a statement regarding their decision, which can be summed up simply. They want people to have a good experience shopping on their website, and have always had a policy regarding intangible eBay selling items-ghosts, souls, etc. This will mean a small number of selections in the metaphysical category of auction selling will no longer be allowed. It is difficult to verify if someone sold a magic spell, or figure out if someone truly got the correct psychic reading. Resolving complaints was very difficult.

Over 1500 people have signed a petition in protest. However, if spells really worked, it would have been much easier to just magic up something that changed the minds of people in charge. Of course, eBay could already be using a powerful spell to stop petitioners. In the world of magic, almost anything is possible. However, in the real world of auction selling you have to have an item with mass and weight in order to sell it. At least according to eBay.

Selling Counterfeit Designer Handbags Is Risky Business

There is no doubt that the market for designer handbags is huge. Every year millions and millions of dollars are spent by people seeking to own part of an image. The image of taste, style, and distinction is exactly what designer manufacturers are selling. Largely speaking, high-end designer handbags are of impeccable quality, durability, and style. Unfortunately, there are many manufacturers that have developed the technology and purchased the same equipment used by the high-end designers in order to reproduce, with remarkable detail, the same high-end designer bags.

Since the companies who are stealing trademarks and profits from the high-end designers are not declaring themselves as such, there is no way for a consumer to know exactly what went into the manufacturing of these designer handbags. The market for “designer replica bags” is legitimate, or least it is legal, bBut the manufacturers who are passing off their rip-off bags as authentic are the problem.

Who’ Cares if I buy a Designer Knock-Off? No One Is getting Hurt, Right

Some consumers simply don’t care if the handbag is authentic so long as it looks to be so. The argument goes, who is being hurt if I buy a fake Louis Vuitton or a fake Hermes bag?  Aaside from the obvious profits which are lost by the designers, that is a very good question.  Who is being hurt by the manufacturer of these designer knockoff handbags?

The truth is, since these are organizations engaged in criminal activity, we can’t know. There have been suggestions that the knockoff designer handbags market engages in child labor abuses. It has also been suggested that some of the funds generated by counterfeit operations funds terrorism, though I have not found any specific information to confirm that.  Without a doubt, the funds are being used to fund criminal.

Gray Market v. Black Market Goods

Even handbags which are authentic can be sold illegally. It is referred to as “gray market goods”. These products are authentic; however, they are not authorized to be sold the way they are being sold. Goods that are stolen or smuggled are sold often on the Internet, sometimes on eBay. Selling great market goods is illegal just as if it is illegal to sell counterfeit goods. It does not matter if the seller knows if the goods were not obtained through licensed channels.

Designer Inspired Handbags

Designer inspired handbags, on the other hand, are copying the general look and feel of the original designer bags but make obvious efforts to ensure that these bags would never be mistaken for the original designer handbag. Selling designer inspired handbags is legal but remember that you are not allowed to mention the name of the designer from which the design is inspired by.

Declaring your Fakes as Fakes

It is also illegal to sell counterfeit goods even if you declare them as such. The reason for this is that if the manufacturer has replicated the logo or other trademarked design features and then in that bag is counterfeit as opposed to “designer inspired”. Even if you tell your buyers that the fake Coach handbag is a fake, you are still engaging in the trafficking of counterfeit goods.

If you are planning or already are selling high-end designer wholesale handbags, it is imperative that you know your sources. Selling counterfeit goods as authentic on eBay will get you banned at best. At worst you could have a visit from the FBI knocking on your door seizing your entire inventory and possibly taking you to jail. This would be a worst-case scenario, but it has happened.

eBay Adds New Descriptive Conditions for Many Items

eBay Adds New Descriptive Conditions for Many Items

Beginning in mid-May many sellers saw new descriptive item conditions when listing items on eBay. These new item condition descriptions are meant to provide buyers with a better understanding of the condition of the item being sold. Many of the conditions are now relevant to the item category, making them much more useful. For example, some electronic devices now provide the condition description of ‘manufacturer refurbished’.

The selection of a condition description is currently optional but beginning July 27th, all new listings will require one of the new condition descriptions. Not only new listings will have the requirement but also re-listings and sell similar auctions will need one of the more descriptive conditions.

eBay is also mapping some existing conditions to new conditions automatically. Certain sub-categories fall under this circumstance, check eBay’s website here for sub-categories that will be automatically mapped. These changes were announced in the 2010 Summer Seller Update along with other changes such as ‘rewarding sellers for great service’ and ‘more profitable selling’.

Small Business Insurance for eBay Sellers Is Too Often Overlooked

You have spent your time researching products that sell and wholesale, liquidation or drop-ship sources to obtain them.   Whatever business you have decided upon, you cannot forget that it is a business.  Home based businesses often neglect the value of small business insurance to protect them from both property losses and liability lawsuits.  You shouldn’t neglect this very important aspect of your business.

Notify your current insurance company

Your first step is to notify your personal insurance carrier whether under a homeowner’s or renter’s policy.  It might be possible to add a Home Business endorsement to the policy.  If they say, “No”, don’t despair.  Several companies are able to write home based business policies for less than $1,000 per year, often as low as $500.

Valuing your inventory

Wholesale items are easily valued at invoice, but when liquidation merchandise is being sold, it can be more complicated because the amount you purchased the items for can change drastically every month depending on supply.  As a rule of thumb, you should use the same methods for valuing your inventory for insurance purposes as you do for your bookkeeping.

Liability Insurance

Bodily Injury Liability: If you rent a warehouse or storage unit for your inventory, you should have General Liability insurance to cover any accidents that may happen to third parties on your premises.  This could include the warehouse staff, cleaning crews, your landlord, or delivery people.  Even if you are running your business out of your house, you should carry this insurance.

Products Liability: If you are buying overstock merchandise, you most certainly need Products Liability – you could be held liable for defective merchandise.  Don’t think that the original manufacturer will offer you any assistance.  If you are buying wholesale or drop shipping, request to be added as additional insured to their Products Liability policy.  They should be willing to do so.   If not, consider a different source

Media and Advertiser’s Liability: A common exposure faced by eBay sellers is copyright or trademark infringement, unauthorized use of images or logos, and, heaven forbid, claims of counterfeit merchandise trading.  These exposures do require special coverage that extends beyond even a standard business insurance policy.  To have coverage for these types of claims, you need Media and Advertiser’s Liability insurance. Yes, even one person selling stuff out of their basement can be sued as a publisher, because when you create a page on eBay, which is what you are doing.

Starting an eBay business on a shoestring is hard enough without having to consider yet another expense.  The best course of action in the beginning is prevention: don’t use trademarks, images or logos without permission, be careful what you say about the competition, restrict public access to your premises, and publish solid descriptions and disclaimers of liability on your listings.  As your business grows, you should consider your small business insurance as one of the many expenses of a successful business.
